Types of Property Title Deeds (Tapu) in Turkey
A Comprehensive Guide to Understanding Property Ownership Types and Their Characteristics
Understanding the different types of property title deeds (Tapu) in Turkey is an essential step when purchasing real estate or investing in the Turkish property market. Each type reflects a different form of ownership or stage of property registration under Turkish real estate laws and procedures.

Therefore, we are committed to educating our clients about the different types of title deeds and their characteristics, helping them make informed property decisions based on clear and reliable information.”
1. Units in a Building
Condominium Ownership (Kat Mülkiyeti)
Registered ownership of an independent unit, such as an apartment, office or shop, in a completed building.
- Generally applies to buildings that have completed licensing and obtained an occupancy permit (İskân).
- Deed shows: location, block and parcel, unit number, property type, land share, owner.
- Verify: occupancy permit and legal status.

Construction Easement (Kat İrtifakı)
A right registered for a planned unit and its land share before construction is completed.
- Common for off-plan projects and projects still under construction.
- Deed shows: land details, unit number, land share, owner.
- Verify: building permit, project compliance and occupancy permit status.

2. Land
Land Title Deed (Arsa Tapusu)
Ownership of a plot of land, or a share of it, rather than of a unit.
- Construction rights depend on zoning, urban planning and building permits.
- Deed shows: province, district, neighborhood, Ada, Parsel, area, classification, owner.
- Verify: zoning regulations and construction rights.
3. Ownership Structure
Shared Ownership (Hisseli Tapu)
Two or more people jointly own a property. Each owner holds an undivided registered share.
- A share does not necessarily correspond to a specific apartment or physical portion of the property.
- Sales and use may be subject to co-ownership rules.
- Verify: ownership percentages and the rights of the co-owners.

Independent Ownership (Müstakil Tapu)
A common term for property registered to a single owner rather than as a share.
- It can apply to land, buildings or units.
- It does not mean the property is free of mortgages, liens or other restrictions.
- Verify: property classification and registered restrictions.
4. Usage Rights
Timeshare (Devre Mülk)
The right to use a property during specified periods, under Turkish timeshare law.
- Common in resorts and holiday developments.
- Verify: usage periods, terms of use and maintenance obligations.

Note: These terms describe different forms of ownership and registration. They are not all separate or mutually exclusive legal categories.

- Check zoning and permitted land use.
- Make sure there are no mortgages, liens or restrictions.
- Confirm that the actual property matches the approved plans.
